2022 Tennessee Legislative Victories

Here’s a look at some of NFIB’s victories in the 2022 session of the Tennessee General Assembly:

Yes on 1! Right-to-Work Protection

NFIB was a leader in getting Amendment 1 on the 2022 Ballot, which will further protect workers’ rights to decide whether they want to join a union or not. VOTE YES ON 1 this November!

Privilege Tax Repeal for Doctors

NFIB led the charge for full repeal of the professional privilege tax for physicians and osteopathic Physicians. 2022 is the last year these professionals must pay the $400 annual tax.

Retailers Receive Relief

Tennessee has restored “vendors’ compensation” for one year beginning July 1, 2022. Retailers will receive up to $300 per location (for separately filed tax returns) to collect and remit sales tax to the state. NFIB will continue to advocate for permanent relief.

R&D Deduction for TN Businesses

Tennessee became the first state to allow companies doing business in our state to fully deduct research & development expenses from their excise tax filings. The legislation, which protects manufacturers and others with R&D spending, was needed because of expiring provisions in the 2017 Tax Cuts & Jobs Act.

COVID-19 Small Business Relief Funds

Small businesses hurt by the pandemic received two rounds of state small business grants, strongly supported by NFIB, between $2,500 and $30,000. NFIB also supported legislation to protect small business from a surprise tax on those relief payments, an NFIB priority.

Unemployment Relief and Reforms

NFIB successfully supported:

   ■ Nearly $1 billion in stimulus dollars directed to the UI Trust Fund, saving small businesses from tax increases of 300% or more (an average $300 per employee).
   ■ State authority to “non-charge” employer accounts because of layoffs during COVID-19.
   ■ A modernization bill that will help promote transitions back to work sooner and net the trust fund $17M/year.
   ■ Establishment of a refusal to work form for employers wanting to report job interview “no-shows.”

Workers’ Comp Rates Stay Low

Workers’ compensation rates have declined as much as 60% since the 2014 reforms, something NFIB worked hard to achieve and continues to monitor.
