L&I Issues Draft Guidance on New Job-Posting Requirements

Date: August 23, 2022

Agency offering a second public comment period until September 16

Senate Bill 5761, which goes into effect Jan. 1. 2023, amended part of the state’s Equal Pay and Opportunities Act regarding job-posting requirements.

The Department of Labor & Industries, which is charged with refining and enforcing SB 5761, has just issued specifics on the new regulation after an initial period of public comment.

According to the L&I, “Under the new law, employers will have to include information in job postings such as a wage/salary range, and a general description of all benefits and other compensation. These requirements apply only to employers with 15 or more employees. The program rewrote portions of the draft policy to provide additional clarity around these requirements.”

Now, L&I is having a second public comment period until September 16. NFIB members are highly encouraged to review the new law here.  Should you have any concerns, you can tell the Department here, or by sending it an email here. A letter can be sent to:

Out of an abundance of caution related to COVID-19 and promoting social distancing, this discussion will be held as a web conference,” according to the agency. “To attend by computer, click the Sept. 6 Zoom link and submit the passcode ES092022! at the prompt.
