New York State Outlines New Business Restriction Strategy Based on Regional Hospitalizations

Governor Cuomo announced potential new business restrictions based on each region’s hospital capacity and hospital stabilization rates. A region that reaches critical hospital capacity will be designated as a “red zone.” Critical hospital capacity is reached when a region’s 7-day average hospitalization growth rate shows that the region will reach 90% capacity within 3 weeks. A designated “red zone” requires the closure of all non-essential businesses and limits restaurants to delivery and take-out only.

Additionally, if a region’s hospitalization rate does not stabilize in the next five days, new restrictions on indoor dining will take effect as early as December 14th. Indoor dining will be suspended in New York City if hospitalizations continue to increase, and indoor capacity limits will be reduced from 50% to 25% for regions outside of New York City.
