What Legalized Marijuana Means for Small Business

Date: November 14, 2018

A new law legalizes recreational marihuana in the state of Michigan

On election day, all three of the ballot proposals that were put before Michigan voters were approved and are now law. One of those proposals, the Michigan Regulation and Taxation of Marihuana Act will have far-reaching implications for Michigan employers and employees. In summary, the law legalizes recreational marihuana in the state of Michigan. The initiative will become law 10 days after election results are certified, which legally must happen by at least November 26.

It is important for employers to understand that, although the proposal legalizes marijuana for adult recreational use, employers can still refuse to hire or retain employees who violate workplace drug policies.

Michigan Leadership Council member and labor attorney, Dan Cohen, with the law firm of Ogletree Deakins has provided a fact sheet for employers that explains the law and what rights employers have in managing this issue in the workplace.
